PRIVACY POLICY

PURPOSE

We are committed to maintaining the accuracy, confidentiality, and security of our users’ personal information. This Privacy Policy describes the personal information that we collect from or about our clients and/or website and mobile application users, how we use that information, and to whom it is disclosed.

This Policy is designed to comply with the privacy requirements established by the State of New York, as well as other relevant laws of the United States of America, and is intended to protect an individual’s privacy under these laws. It supports our need to collect information from our users as necessary for our performance of business services and functions, while also recognizing a user’s right to have their information handled in a way that protects the privacy of their personal information.

Privacy laws vary from country to country. Our Privacy Policy is not designed to encompass worldwide privacy laws. Accordingly, if you choose to contract our services or access our website or mobile application from other locations outside of the United States, you do so on your own initiative and, upon your use of our website, you consent that the United States has jurisdiction over any dispute that may arise pertaining to our Privacy Policy, our services, or the use of our website.

COMMENCEMENT

This Policy will commence from September 14, 2018. It replaces all other policies relating to the use of a user’s personal data, whether such a policy was made in writing or oral.

APPLICATION

This Policy applies to all users of our services, our website, and our mobile application, even those who contract our services or access our site from a location outside of the United States. By using our services and/or website, you agree to be bound by the provisions described in our Privacy Policy as well as our Terms and Conditions and any services contract you may enter in to with us, each of which are incorporated in to and made part of this Privacy Policy by reference.

INFORMATION COLLECTED

We only collect information that is necessary for one or more of our legitimate business functions or activities. The information we collect from our users may include:

• Personal information, including, but not limited to, your name, gender, date of birth, nationality, military status, if applicable, and any other information that may be obtained from your driver’s license.
• Personal information that is considered “special” by nature including, but not limited to, your race and ethnicity.
• Automobile insurance information you voluntarily share with us including, but not limited to, policy holder’s name, policy number, policy expiration date, and insurance provider information.
• Contact information, including, but not limited to, your permanent address, mailing address, telephone number(s), and email address.
• Geographical data including, but not limited to, the location and date/time of pick-up/drop-off.
• Account login information including, but not limited to, your login credentials and profile data.
• Network traffic data including, but not limited to, your IP address, identification numbers, location data, cookies, online identifiers, language settings, and device identification.
• Financial information provided by you including, but not limited to, bank account and credit card information.
• Information you voluntarily share with us including, but not limited to, suggestions, reviews, opinions, and feedback.
• Images, documents, videos, or other information you voluntarily share with us including, but not limited to, photographs and documents shared with us in your profile account.
• Social media links or content you voluntarily share with us including, but not limited to, images, contacts, and written content.
• We may also collect information from third party channels including, without limitation, factual research our employees perform on you or your business, or from your interactions with our employees.

We collect and process personal information from our users so that we may perform our business functions and provide services to the user. We may use a user’s personal information to perform the following:

• To perform legitimate business functions including, but not limited to, facilitating the business relationship between cab companies, car service providers, drivers, and/or riders through our Cabscout network.
• To facilitate billing and payment collection for our services, if applicable.
• To market relevant services to you based on your preferences selected during the creation or use of your profile account.
• To send electronic communications including, but not limited to, email newsletters or push notifications (you have the option to unsubscribe to these).
• To allow our employees or representatives to provide business services in accordance to your contract.
• To facilitate customer feedback and support, which allows us to improve our services and site designs and/or functionality.
• To comply with legal obligations arising out of the performance of our business services to you.
• To perform background checks as permitted or required by applicable law.
• To defend any legal claims to which we are subject.
• Any other legitimate business functions or activities.

SHARED INFORMATION

We will never sell your personal information, although it may be shared from time to time, and only when necessary to perform a legitimate business function, including facilitate the business relationship between cab companies, car service providers, drivers, and riders.

Specifically, your information may be shared within our Cabscout network, via use of our website and mobile application, to: (1) allow cab companies and other car service providers to manage their drivers general business activities; (2) allow cab companies and other car service providers to manage their customers and payments; (3) allow drivers to manager their schedules; and (4) allow riders to select which cab company or other car service provider he/she wishes to use. By default, your information will be shared within the Cabscout network, however you may opt out of or limit the sharing of your information within the network through your account settings.

We may provide your personal information data that we have collected through our website or mobile application to third party service providers to help us deliver and/or promote products, information, correspondence, services, marketing, or other legitimate business functions as well as perform billing and payment activities (specifically, we use Stripe Billing for billing services). We will have a written agreement with each third party confirming on what basis they will use your personal information and we will ensure that there are adequate safeguards and processes in place to protect your personal data.

We also use Google® Maps to calculate distances between pick-up and drop-off locations. Any information inputted in to Google® Maps may be transmitted to Google’s servers, which are not in our control.

Additionally, we may be required by law to submit your personal information to law enforcement and/or a judicial or governmental authority pursuant to a subpoena or court order. We may also provide your personal information to law enforcement to cooperate with an investigation in to suspected illegal activities. Any such disclosures shall be made at our sole discretion and in good faith.

It is important to note that we have no control over a third-party’s privacy practices, including those governed by cab companies or other car service providers. We are not responsible for any breach of privacy resulting from any action or inaction by a third-party, whether intentional or otherwise.

RETENTION OF PERSONAL DATA

In compliance with applicable U.S. laws and regulations, we keep your personal information data for the period necessary to fulfil the purposes for which it has been collected. We may retain and use your data for future marketing or promotional purposes, in the event you have consented to us doing so.

SECURITY

It is important to us that your personal information is kept secure. Our website is provided through GoDaddy and is secured through a Secure Sockets Layer (“SSL”) Certificate, which ensures the security of data sent via the Internet using encryption. Our website also uses Hypertext Transfer Protocol Secure, or “HTTPS,” to secure communications over the network.

We take precautions to protect your personal information however we cannot always guarantee the security of your personal information. Transmissions over wireless networks, including the Internet, can, at times, be defective, falsified, or tampered with. You acknowledge and agree that such circumstances are out of our control, and we cannot be held responsible or liable any limitation, failure, or breach of any transmission of your personal information over wireless networks.

CALIFORNIA RESIDENTS

California is regulated by additional privacy laws, specifically the “Shine the Light” law (California Civil Code §1798.83). Under this law, businesses must disclose to the consumer a complete list of all personal information disclosed to third-parties and the nature of such disclosure within thirty (30) days of such a request.
